Crítica de la Justicia Sustantiva adopta una política de acceso abierto inmediato y gratuito para todos sus contenidos. Esto significa que todos los artículos publicados están disponibles para el público sin costo alguno, permitiendo su lectura, descarga, copia, distribución y uso sin restricciones, siempre que se cite adecuadamente la fuente y los autores. La revista se adhiere a los principios del Open Access para fomentar la difusión amplia y equitativa del conocimiento académico, contribuyendo a la visibilidad y el impacto de la investigación en justicia sustantiva.

Los autores conservan los derechos de autor de sus trabajos y conceden a la revista una licencia para publicar bajo una licencia Creative Commons (por ejemplo, CC BY), que permite el uso flexible y responsable del contenido. No se cobran cargos por procesamiento de artículos (APC), garantizando así un acceso abierto sin barreras económicas para autores y lectores.
