Abstract

This article critically examines the ethical foundations and political implications of civil disobedience, asking whether acts of law-breaking can serve as legitimate paths toward social justice. Through a normative analysis grounded in political philosophy and real-world case studies—including climate justice actions, anti-racist movements, and indigenous land occupations—the research interrogates the tension between legal authority and moral obligation. The study introduces a framework for evaluating disobedience not merely as defiance of law, but as an ethical response to systemic injustice when institutional channels have failed. The novelty of this work lies in its intersectional and decolonial approach, integrating perspectives often excluded from liberal theories of civil disobedience. By questioning who gets to define legality and justice, this article contributes to rethinking the role of dissent in democratic societies and the ethical boundaries of resistance.

Este artículo examina críticamente los fundamentos éticos y las implicaciones políticas de la desobediencia civil, cuestionando si los actos de transgresión legal pueden constituir vías legítimas hacia la justicia social. A partir de un análisis normativo anclado en la filosofía política y estudios de caso reales—como las acciones por la justicia climática, los movimientos antirracistas y las ocupaciones indígenas de tierras—la investigación analiza la tensión entre autoridad legal y obligación moral. El estudio propone un marco para evaluar la desobediencia no solo como desafío a la ley, sino como respuesta ética ante injusticias sistémicas cuando los canales institucionales han fallado. La originalidad del trabajo radica en su enfoque interseccional y descolonial, incorporando perspectivas frecuentemente excluidas de las teorías liberales sobre la desobediencia civil. Al cuestionar quién define la legalidad y la justicia, el artículo contribuye a replantear el papel de la disidencia en las sociedades democráticas y los límites éticos de la resistencia.
